1. Introduction and Acceptance of Terms

Welcome to Europe Careers.

These Terms and Conditions govern your access to and use of the website www.europecareers.de and the services offered by Europe Careers through its website, authorised representatives, consultations, training programmes, and other communication channels.

By accessing the website, submitting an enquiry, registering for a service, or entering into a service agreement with Europe Careers, you agree to comply with the applicable terms described in this document.

Where a particular service requires a separate written agreement, enrolment agreement, recruitment agreement, fee schedule, or other contractual document, that agreement will govern the specific service in conjunction with these Terms and Conditions.

Nothing in these Terms and Conditions excludes or limits any mandatory consumer protection, employment, data-protection, or other statutory right that cannot lawfully be excluded or limited.

If you do not agree with the terms applicable to your use of the website or a service, please discontinue the relevant use or do not enter into the relevant service agreement.

2. Company Information

Organisation: Europe Careers
Website: www.europecareers.de
Email: info@europecareers.de

Legal entity name: To be completed with the verified registered name of the entity operating the website.

Registered address: To be completed with the verified registered business address.

The identity and legal status of the contracting entity must be confirmed in the relevant service agreement, invoice, or other applicable contractual documentation before a customer enters into a paid contract.

References to “Europe Careers”, “we”, “us”, or “our” in these Terms refer to the verified contracting entity responsible for the relevant service.

3. Scope of Services

Europe Careers provides information, counselling, training, recruitment-related assistance, and other services concerning international education and career opportunities.

Depending on the service specifically offered and agreed, these services may include:

  • International recruitment and career counselling.
  • Nursing and healthcare career opportunities.
  • Medical professional career guidance.
  • Ausbildung and vocational training guidance in Germany.
  • German language training and examination preparation.
  • Study-abroad counselling and education application support.
  • Professional qualification recognition and documentation assistance.
  • Application preparation and coordination.
  • General visa and relocation process information.
  • Related administrative support and candidate guidance.

The exact scope of any service will be determined by the relevant service description, written quotation, enrolment confirmation, or individual contract.

The availability of a service may depend on eligibility requirements, the destination country, applicable regulations, the availability of employers or institutions, and the terms agreed with the customer.

A service mentioned on the website is not necessarily available to every candidate or in every location.

4. Nature and Limitations of Our Services

Unless expressly agreed otherwise in a separate written contract, Europe Careers provides counselling, training, coordination, recruitment-related assistance, application support, or information services within the agreed scope.

Europe Careers does not automatically act as:

  • The employer of a candidate placed with another organisation.
  • A government authority or immigration authority.
  • A university, hospital, examination body, or professional licensing authority.
  • A visa-issuing authority.
  • A guarantor of admission, employment, professional recognition, or immigration outcomes.

Any specific regulated activity will be undertaken only where the responsible entity is legally entitled to provide it.

Where another organisation makes the final decision, Europe Careers cannot replace that organisation’s authority or guarantee its decision.

5. Eligibility and Candidate Requirements

Customers and candidates are responsible for ensuring that they meet the eligibility requirements applicable to the service they request.

Depending on the programme, these requirements may include:

  • Minimum educational qualifications.
  • Relevant professional qualifications or experience.
  • Professional registration or licensing.
  • German or another language proficiency.
  • Age or other eligibility criteria imposed by the relevant programme or authority.
  • Financial requirements.
  • Valid identification and travel documents.
  • Health, background, or other legally applicable requirements.
  • Admission, employer, or professional recognition criteria.

Europe Careers may request relevant documents or information to assess whether a candidate appears to meet the stated requirements.

Any preliminary assessment is based on the information available at that time and is not a binding decision by an employer, educational institution, professional authority, or government body.

Meeting an initial eligibility requirement does not guarantee final acceptance or approval.

6. Accuracy of Information Provided by Customers

Customers must provide accurate, complete, and current information when making enquiries, registering for services, applying for opportunities, or participating in a programme.

Customers are responsible for:

  1. Providing genuine and valid documents.
  2. Disclosing relevant qualifications and employment history accurately.
  3. Correcting material errors or omissions promptly.
  4. Informing Europe Careers of changes that may affect an application.
  5. Ensuring that documents submitted on behalf of another person may lawfully be shared.
  6. Cooperating with reasonable verification requests relevant to the agreed service.

Customers must not submit forged certificates, altered documents, false employment records, misleading declarations, or inaccurate personal information.

Europe Careers may suspend work on an application while material inconsistencies are clarified. Where there is a reasonable basis to suspect fraud, unlawful conduct, or a serious breach of contract, Europe Careers may decline or terminate the relevant service in accordance with applicable law and the relevant agreement.

Any consequences arising from knowingly false information may affect the candidate’s application, eligibility, or contractual position. Europe Careers does not assume responsibility for the consequences of information that a customer knowingly provides incorrectly or conceals.

7. No Guarantee of Employment or Placement

Europe Careers may assist candidates with recruitment-related services, employer communication, application preparation, interview coordination, and career guidance.

However, unless a specific written agreement expressly provides a legally enforceable commitment, Europe Careers does not guarantee:

  • An interview or interview invitation.
  • A job offer or employment contract.
  • Selection by a particular employer.
  • A particular salary, benefit, or working schedule.
  • Employment within a specified period.
  • A specific job location or employer.
  • A particular number of vacancies.
  • Continued employment after placement.

Recruitment outcomes depend on factors including the candidate’s qualifications, language proficiency, interview performance, employer requirements, available vacancies, and applicable employment regulations.

An advertised opportunity is not a guarantee that the position will remain available or that any particular candidate will be selected.

Where an employer changes, suspends, or withdraws a vacancy, Europe Careers will communicate material information to the extent reasonably possible and consistent with its contractual obligations.

Nothing in this section excludes any specific placement commitment expressly agreed in writing.

8. No Guarantee of Visa or Immigration Outcomes

Visa and immigration decisions are made by the competent authorities of the relevant country.

Europe Careers cannot guarantee:

  • Visa approval.
  • Immigration permission.
  • A particular processing time.
  • An appointment at an embassy or consulate.
  • Approval of a residence or work permit.
  • A particular immigration route or legal status.
  • Entry into or continued residence in a destination country.

Any visa-related assistance will be limited to the services specifically agreed.

Customers are responsible for providing genuine documentation, meeting applicable financial and eligibility requirements, attending appointments when required, and complying with the relevant authority’s instructions.

Government fees, appointment availability, document requirements, and processing times may change without notice to Europe Careers.

If a visa or immigration application is refused, delayed, or returned for additional information, the consequences will depend on the circumstances, the relevant agreement, applicable law, and any services already performed.

Europe Careers will not be responsible for an authority’s independent decision merely because the customer obtained assistance from us. This does not exclude liability for any breach of our own contractual or legal obligations.

9. Professional Recognition and Qualification Approval

For healthcare professionals, skilled workers, and other regulated occupations, the relevant authority may require qualification assessment, document verification, additional training, examinations, language proficiency, or other measures.

Europe Careers may provide guidance or coordination relating to professional recognition where this service is agreed.

However, the final decision regarding recognition, licensing, registration, equivalence, professional authorisation, or the right to practise rests with the competent authority.

Europe Careers does not guarantee:

  • Recognition of a qualification.
  • Approval of professional registration.
  • Exemption from additional examinations.
  • A particular recognition decision.
  • Permission to practise a regulated profession.
  • Completion of the process by a particular date.

Candidates must provide accurate qualifications and comply with the requirements communicated by the competent authority.

Any specific undertaking concerning document preparation or administrative support will be limited to the scope expressly agreed in writing.

10. German Language Training and Examination Preparation

Where Europe Careers provides or arranges German language training, the applicable course description, enrolment terms, timetable, and fee schedule will govern the programme.

Customers are responsible for attending classes, completing assignments, participating in assessments, and following the applicable course rules.

Unless expressly guaranteed in a separate written agreement, Europe Careers does not guarantee:

  • Passing a Goethe, telc, or other language examination.
  • Achieving a particular proficiency level by a specific date.
  • Admission to an examination centre.
  • A particular examination score.
  • Employment or admission as a result of completing a course.

Examination fees, certification fees, external assessments, and third-party services may be charged separately where disclosed in advance.

Where a course is delivered by an independent training provider, the relevant provider’s contractual terms may also apply.

Changes to class schedules, instructors, or delivery arrangements will be managed in accordance with the applicable course agreement and mandatory law.

11. Ausbildung and Education Applications

Europe Careers may provide information or assistance concerning Ausbildung, vocational education, university admission, and other study opportunities.

Customers acknowledge that admission and selection decisions are made by the relevant institution, employer, training provider, or other authorised organisation.

Submitting an application does not guarantee admission, a training contract, a stipend, accommodation, funding, or a visa.

Any advertised stipend, salary, tuition fee, scholarship, or financial benefit is subject to the actual programme terms, eligibility conditions, and the decision of the relevant provider.

Customers should review the official terms of the relevant institution or employer before making financial or personal commitments.

Europe Careers is not responsible for independent changes to an institution’s admission criteria, course availability, funding arrangements, or programme requirements, except to the extent that responsibility arises from our own breach of contract or applicable law.

12. Third-Party Services and Independent Decisions

Some services depend on third parties, including employers, universities, training providers, examination centres, translation services, accommodation providers, insurers, travel providers, and government authorities.

Where these third parties make independent decisions or provide separate services, their own terms and conditions may apply.

Europe Careers cannot control every aspect of a third party’s operations, availability, decision-making, or processing time.

However, this does not remove any responsibility Europe Careers has for its own contractual obligations, its own conduct, or any services for which it is legally responsible.

Where a third-party service is arranged on behalf of a customer, the relevant quotation or agreement should identify the service provider, the applicable fees, and the respective responsibilities where reasonably necessary.

13. Fees, Quotations, and Payment

The fees payable for a service will be set out in the applicable quotation, fee schedule, invoice, enrolment agreement, or individual contract.

Unless expressly stated otherwise, the following principles apply:

  1. Customers must pay the agreed fees in accordance with the stated payment schedule.
  2. Any deposit, instalment, or advance payment must be disclosed in the applicable agreement.
  3. Taxes will be handled as required by applicable law and the agreed price presentation.
  4. Government charges, examination fees, translations, certifications, travel expenses, and third-party fees will be identified separately where they are not included in the agreed service price.
  5. Additional work outside the agreed scope may require a separate quotation and the customer’s agreement.
  6. Customers should raise any invoice query promptly so that it can be reviewed.

No additional charge will be imposed without an applicable contractual basis or other lawful entitlement.

Europe Careers may pause non-essential work where an undisputed amount remains overdue, provided that doing so is lawful and consistent with the applicable agreement. Any suspension will be proportionate and will not remove mandatory statutory rights.

Payment does not guarantee a job, admission, visa, professional recognition, or other result unless a specific legally enforceable commitment has been expressly agreed.

14. Refunds and Cancellation

Refunds and cancellations are governed by the applicable service agreement, the disclosed cancellation policy, and mandatory law.

14.1 Statutory Withdrawal Rights

Where a customer qualifies as a consumer and a contract is concluded at a distance or away from business premises, statutory withdrawal rights may apply.

For many eligible service contracts, the withdrawal period is 14 days from the conclusion of the contract.

The applicable withdrawal period, exceptions, notice requirements, and refund consequences depend on the type of contract and the circumstances.

Where legally required, Europe Careers will provide the customer with the prescribed withdrawal information and withdrawal form.

14.2 Services Started During the Withdrawal Period

If a customer expressly requests that a service begin during an applicable withdrawal period, the customer may be required to pay a proportionate amount for services actually provided before withdrawal, where the legal conditions are met.

The loss of a statutory withdrawal right upon full performance of a service is subject to specific legal requirements, including the relevant express consent and acknowledgement where required.

These provisions will not be applied automatically or in a manner that removes rights that the law preserves.

14.3 Customer-Initiated Cancellation

Outside a statutory withdrawal period, cancellation rights and any applicable charges will be determined by the relevant service agreement and mandatory law.

Any cancellation charge must have a lawful contractual basis and must not exceed what is legally permissible.

Where appropriate, refunds may take account of services already performed, authorised third-party expenses actually incurred, and other amounts lawfully payable under the agreement.

14.4 Refund Requests

Refund requests should be sent to info@europecareers.de with the customer’s name, relevant invoice or agreement number, service details, and the reason for the request.

Europe Careers will review the request and communicate the outcome in accordance with the applicable agreement and law.

Nothing in this section excludes a refund, reimbursement, or other remedy required by law.

15. Customer Responsibilities and Cooperation

Customers must cooperate reasonably with the delivery of the agreed services.

This includes:

  • Responding to relevant requests for information.
  • Providing documents within reasonable deadlines.
  • Attending agreed appointments or interviews.
  • Reviewing documents prepared on their behalf.
  • Informing Europe Careers of material changes to their circumstances.
  • Following the relevant employer’s, institution’s, or authority’s instructions.
  • Keeping copies of important documents and correspondence.

Delays caused by missing information, inaccurate documents, failure to respond, or missed appointments may affect the delivery schedule.

Where a customer’s actions materially prevent or delay performance, Europe Careers will communicate the issue and seek a reasonable resolution.

Any resulting fee adjustment, suspension, or termination must be consistent with the relevant agreement and applicable law.

16. Communication and Electronic Records

Europe Careers may communicate with customers through email, telephone, online meetings, messaging platforms, or other agreed channels.

Customers are responsible for providing accurate contact information and checking relevant communications.

Electronic communications may be used to provide quotations, appointment confirmations, application updates, invoices, and other contractual information where legally permitted.

Important contractual notices should be sent to the contact address specified in the applicable agreement or to info@europecareers.de, as appropriate.

A message being sent does not necessarily establish that it was received, accepted, or legally effective. Receipt and effectiveness will be determined by the applicable agreement and law.

17. Intellectual Property Rights

Unless otherwise stated, website content and materials made available by Europe Careers, including text, graphics, logos, designs, photographs, layouts, training materials, documents, and other original content, are owned by or used under licence by the relevant rights holder.

You may access and use these materials for personal, non-commercial purposes associated with the intended use of the website or service.

Without the required permission, you must not:

  • Copy or republish substantial website content for commercial use.
  • Sell, distribute, or commercially exploit our proprietary training materials.
  • Remove copyright notices or ownership information.
  • Reproduce our branding in a manner that suggests unauthorised affiliation.
  • Modify or distribute protected content beyond what applicable law permits.
  • Use our materials to create misleading advertisements or impersonate Europe Careers.

Nothing in this section restricts uses permitted by mandatory law, including applicable copyright exceptions.

If you believe that content on our website infringes your intellectual property rights, contact info@europecareers.de with sufficient details for us to review the concern.

18. Prohibited Website Use

You must not use the website or our services to:

  1. Engage in unlawful, fraudulent, or deceptive activity.
  2. Submit forged, stolen, or knowingly misleading documents.
  3. Impersonate another person or organisation.
  4. Gain unauthorised access to systems, accounts, or restricted information.
  5. Introduce malware or interfere with website security.
  6. Scrape, harvest, or collect personal data unlawfully.
  7. Send spam or unauthorised commercial communications.
  8. Misrepresent your relationship with Europe Careers.
  9. Copy protected materials in violation of applicable rights.
  10. Interfere with the availability, integrity, or proper operation of the website.

We may take proportionate action in response to suspected misuse, including restricting access, investigating the incident, preserving relevant evidence, or referring unlawful conduct to the appropriate authority where legally justified.

Any restriction or termination will remain subject to applicable law and any contractual obligations owed to the customer.

19. Website Information and Availability

We aim to provide useful and reasonably accurate information on our website. However, information may change as a result of updated programme requirements, employer decisions, government regulations, or other developments.

Website content is generally provided for informational purposes and does not constitute an individual contractual offer unless expressly stated.

We do not guarantee uninterrupted availability, error-free operation, or compatibility with every device or browser.

We may update, maintain, suspend, or modify website features where reasonably necessary for operational, security, or business reasons.

Where a change materially affects an existing paid service, the relevant contractual terms and mandatory law will apply.

Nothing in this section excludes liability for misleading statements, contractual breaches, or other matters for which liability cannot lawfully be excluded.

20. Limitation of Liability

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Subject to that principle, the following provisions apply.

20.1 Liability That Cannot Be Excluded

Europe Careers remains liable in accordance with applicable law for:

  • Intentional misconduct and fraud.
  • Gross negligence.
  • Injury to life, body, or health where liability arises under applicable law.
  • Mandatory statutory product liability, where applicable.
  • Express guarantees or commitments to the extent legally binding.
  • Any other liability that cannot lawfully be excluded or limited.

20.2 Breach of Essential Contractual Obligations

Where legally permissible, liability for a negligent breach of an essential contractual obligation will be limited to the damage that was foreseeable and typical for the contract when it was concluded.

An essential contractual obligation is one whose performance is necessary for the proper execution of the contract and on whose performance the customer may ordinarily rely.

20.3 Other Negligent Breaches

Where permitted by applicable law, liability for other negligent breaches of duty may be excluded or limited to the extent legally permissible.

20.4 Independent Third-Party Decisions

Europe Careers is not responsible merely because an independent employer, educational institution, examination body, professional authority, or government agency makes a decision that is unfavourable to a customer.

This does not exclude responsibility for Europe Careers’ own acts, omissions, contractual breaches, or other legally attributable conduct.

20.5 No Unlawful Blanket Exclusion

Nothing in this section is intended to exclude liability for a failure to provide a service that Europe Careers has expressly and validly undertaken to provide.

Any limitation of liability will be interpreted subject to applicable mandatory law.

21. Indemnification and Claims Arising from Customer Misconduct

Where legally permissible, a customer may be responsible for direct losses or reasonable costs that Europe Careers incurs as a result of the customer’s intentional unlawful conduct, fraud, or material breach of contract.

This may include losses arising from knowingly forged documents, unauthorised use of intellectual property, or deliberate interference with our systems.

Any claim must be supported by an appropriate legal basis and assessed in light of the customer’s conduct, causation, applicable law, and the parties’ respective responsibilities.

Nothing in this section requires a consumer to indemnify Europe Careers for losses caused by Europe Careers’ own conduct where such a requirement would be unlawful or unenforceable.

22. Confidentiality and Data Protection

Europe Careers handles personal data in accordance with its Privacy Policy and applicable data-protection legislation.

The Privacy Policy explains the categories of personal data collected, the purposes and legal bases for processing, data recipients, retention, international transfers, and applicable privacy rights.

Customers should review the Privacy Policy before submitting personal information or documents.

Contractual confidentiality obligations, where applicable, will be governed by the relevant service agreement and mandatory law.

Nothing in these Terms authorises the processing or disclosure of personal data in a manner prohibited by applicable data-protection law.

23. Suspension and Termination of Services

A service may end in accordance with its agreed duration, completion terms, cancellation provisions, or other contractual arrangements.

Where legally justified, Europe Careers may suspend or terminate a service if:

  • The customer materially breaches the relevant agreement.
  • The customer knowingly provides fraudulent documents or material false information.
  • Continued performance would be unlawful.
  • The customer fails to meet an essential contractual obligation after any legally required notice or opportunity to remedy the breach.
  • Circumstances arise that make the agreed service impossible or unlawful.

Where appropriate and legally required, Europe Careers will provide notice and a reasonable opportunity to resolve the issue.

Termination does not automatically eliminate payment obligations that have lawfully accrued or refund rights that remain available under the agreement or applicable law.

Any remaining fees, refunds, outstanding services, and return or deletion of documents will be handled according to the relevant agreement and applicable law.

Customers retain any statutory right to terminate or withdraw from a contract where applicable.

24. Force Majeure and Events Beyond Reasonable Control

Neither party will be treated as automatically liable for a delay caused by an event beyond its reasonable control, to the extent recognised by applicable law.

Examples may include natural disasters, serious infrastructure failures, widespread service outages, governmental restrictions, armed conflict, or other extraordinary events.

The affected party should notify the other party within a reasonable time where practicable and take reasonable steps to mitigate the effects.

This section does not automatically cancel payment obligations for services already provided or remove statutory consumer remedies.

If the event prevents continued performance, the parties’ rights and obligations will be determined by the relevant agreement and applicable law.

25. Complaints and Dispute Resolution

If you have a complaint about a service, payment, communication, or contractual matter, please contact:

Email: info@europecareers.de

Please provide your name, relevant service or agreement details, and a clear description of the issue.

Europe Careers will review the complaint and seek to respond within a reasonable period.

Where a complaint concerns a statutory consumer right, it will be handled in accordance with the applicable legal requirements.

Nothing in this section prevents a customer from contacting a competent authority, consumer advice organisation, court, or other body where the customer has a legal right to do so.

Any applicable statutory information about recognised consumer dispute-resolution bodies or participation in alternative dispute resolution should be provided separately where required.

26. Governing Law and Jurisdiction

These Terms and Conditions and the contractual relationship between the parties are governed by the law applicable to the relevant agreement, subject to mandatory consumer protection and other overriding legal requirements.

Where the contracting entity is established in Germany, German law may govern the relevant agreement, subject to applicable conflict-of-law rules and mandatory protections.

If a customer qualifies as a consumer residing in another jurisdiction, that customer’s mandatory statutory protections and any applicable rules governing jurisdiction will remain unaffected.

Nothing in these Terms deprives a consumer of rights that cannot lawfully be waived or restricts access to a court that has jurisdiction under mandatory law.

The competent courts will be determined in accordance with the applicable legal rules. Any exclusive jurisdiction clause for business customers will apply only where legally valid.

27. Amendments to These Terms

We may update these Terms and Conditions where necessary to reflect changes in our services, business operations, website functionality, or applicable law.

The updated version will be published on this website with a revised “Last Updated” date.

Changes will not automatically modify an existing contract where the customer’s agreement or another legal basis is required.

Where a change materially affects an existing contractual relationship, we will follow the applicable agreement and legal requirements, including obtaining consent where necessary.

We recommend reviewing these Terms periodically when using the website or entering into a new service agreement.

28. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision will be treated in accordance with applicable law.

The validity of the remaining provisions will not automatically be affected, provided they can lawfully continue to operate independently.

This section does not authorise the replacement of an invalid consumer term with a provision that unlawfully worsens the customer’s position.

29. No Waiver

A failure or delay by Europe Careers in exercising a contractual right does not automatically constitute a waiver of that right.

Any waiver or amendment must be assessed according to the relevant agreement and applicable law.

No provision in this section restricts rights or remedies that arise under mandatory law.

30. Entire Agreement and Service-Specific Terms

These Terms and Conditions govern the relevant website use and, where incorporated into a service contract, form part of that contract.

The applicable quotation, enrolment agreement, service description, fee schedule, or separate written contract may contain additional details specific to a service.

Where a service-specific agreement expressly overrides a provision of these Terms, that agreement will prevail to the extent legally valid.

No website statement, informal discussion, or general description automatically creates a guarantee unless the relevant commitment forms part of a legally binding agreement.

Nothing in this section excludes legally binding representations, statutory rights, or remedies that apply independently of these Terms.
